Terms and definitions
1. FeelPrime.com (website)- is a website available at http://www.FeelPrime.com (and http://www.FeelPrime.pl), providing Internet services.
2. Apartment - is an accommodation place offered for rent by a Lessor at FeelPrime.com.
3. Client - a Lessee of an apartment
4. Lessor - a business entity which has the right to rent an Apartment.
5. Booking - is the conclusion of an agreement between the Client and the Lessor. This agreement is concluded via FeelPrime.com website and it determines lease time of the Apartment, and additional services which purchased by the Client.
6. Booking Form - a Client’s registration form including the Client’s personal information, the Booking information, the price and the amount of the Advance Payment.
7. Booking Confirmation – an electronic message sent to the Client’s e-mail address after completion of the Booking.
8. Additional services - are the services connected with the lease provided to the Client. The Lessor is obliged to provide the additional services.
9. Rules - are the rules determining the way in which booking is handled at FeelPrime.com. They are available on our website.
10. Advance Payment - is the amount paid into the FeelPrime.com’s account by the Client during the Booking process
Lease time of an apartment
1. A hotel day starts at 2 pm and ends on the last day of the stay at 11 am.
2. Handing over the keys takes place in the building of the Apartment (or in the place agreed with the Lessor) after presenting an ID. The keys will not be given to a person if the personal details of this person are not included in the Booking Form (he/she is not a Client).
3. The Lessor may refuse to hand over the keys if the number of people is larger than the one specified in the Booking Form
4. The Client hands over the keys to the Lessor before the end of the last hotel day.
5. The Client is obliged to inform the Lessor immediately about all the faults and damage occurred during the stay. The Client is also obliged to cover the cost of repairing all the damage which occurred up to the end of the lease time.
6. The Client may use the Apartment only for housing purposes. Sublease without the consent of the Lessor is strictly forbidden.
7. Washing dishes is not included in the price of final cleaning, therefore the Client is obliged to leave the dishes clean.
Complaints and responsibility
1. FeelPrime.com will not be held responsible for any interruptions in the supply of gas, power, running water, electronic media or other ones, resulting from conservation works. Such interruptions are not grounds for claiming damages from FeelPrime.com.
2. If it is not possible to provide the ordered service, FeelPrime.com is obliged to offer the Apartment of a similar standard and at a similar price.
3. If the Client is not interested in changing an apartment or the change is not possible, FeelPrime.com shall reimburse the advance payment.
4. FeelPrime.com will not be held responsible for any damage caused to the Client by the Lessee. Also, FeelPrime.com will not be held responsible for any personal injuries occurring during the stay in the Apartment.
5. FeelPrime.com is absolved of any legal or financial liability in the situation of a conflict or a misunderstanding between the users of FeelPrime.com website, including both the Lessors and the Clients. In such case, no financial or legal claims may be brought against FeelPrime.com.
6. In the case of a justified claim, the whole financial liability of FeelPrime.com is limited by the amount of the advance payment made by the Client and any financial claims shall not exceed this amount.
Booking and changes
1. After filling out and sending the Booking Form, and after paying the advance payment into the account of FeelPrime.com, an e-mail with the confirmation of the booking date is sent to the e-mail address given by the Client within 48 hours. The received Booking Confirmation received and Booking Form shall be a binding agreement between the Client and the Lessor.
2. Before the Client receives the Booking Confirmation, the Lessor reserves the right to cancel the Booking and to refund the money to the Client’s account, as the result of the circumstances which are not dependent on the Lessor.
3. The Advance Payment will not be reimbursed if the Client resigns after making the Advance Payment. However, it is possible to change the booking date. In such a case, it is required to inform FeelPrime.com on the e-mail address booking@feelprime.com, not later than 14 days before the Booking start date. Changing the date may involve a price change.
4. The Client has the right to transfer all the entitlements resulting from the made Booking to another person, and in this case this person assumes all the responsibilities resulting from the Booking mentioned above. It is necessary to send to the e-mail address booking@feelprime.com all the personal information of this person required to fill out the Booking Form.
Payment
1. The only official currency accepted by FeelPrime.com is PLN (Polish Zloty). Prices given in other currencies are just approximate prices based on a daily exchange rate, according to the exchange rate on the day of the booking. All the prices provided VAT.
2. The prices are for using an Apartment for one night.
3. Total Booking price includes utilities and cleaning after the checkout. The Lessor may not charge any hidden or additional fees on account of the Booking, except for the ones specified in the Apartment information.
4. Before the checkout, the Client shall pay the Lessor for using all the additional services during the stay which were not included in the original Booking.
5. The Client has the right to receive a VAT invoice or a simplified invoice from the Lessor for the total sum of the Booking. The Client has to provide the Lessor with all the information necessary to issue an invoice.
6. The Lessor may demand that the Client pays a refundable deposit on checking in, which secures the Lessor against any damage occurring through the fault of the Client. For any damage occurring through the fault of or caused by the Client, the Lessor has the right to retain a part of the deposit equal to the estimated cost of repairing the damage. Information whether the deposit is required is included in the description of each Apartment at FeelPrime.com.
7. There is no additional charge for a child under 7 years old, unless the Client demands an additional bed.
Governing law
1. The Polish law is the governing law for all litigations between the Lessor and the Client. All the litigations shall be settled by a court which has the jurisdiction in the area of the Lessor’s registered office.
